A man convicted of rape and assault in Marion County was arrested in Arizona by Border Patrol agents Sunday.

Agents patrolling the border near Lukeville, Arizona, arrested five men on suspicion of being in the United States illegally, according to U.S. Customs and Border Protection officials.

Among them was 31-year-old Pascual Nava-Gutierrez, a former resident of Donald, Oregon.

While conducting a background check, agents discovered Nava-Gutierrez was convicted of third-degree rape and fourth-degree assault in 2012 before being deported to Mexico.

According to court records, Nava-Gutierrez was convicted of DUI and reckless endangerment in 2008. While he was still on probation in 2010, a Marion County grand jury indicted him on charges of third-degree rape, fourth-degree assault and harassment and issued a warrant for his arrest.

He was taken into custody two years later on new assault charges. After pleading guilty to rape and two counts of assault, Nava-Gutierrez was sentenced to 90 days in jail, five years probation, batterer intervention treatment and ordered to register as a sex offender.

A U.S. Immigration and Customs Enforcement hold was placed on him while he was incarcerated at Marion County jail.

Border patrol officials said Nava-Gutierrez will remain in custody pending prosecution for criminal immigration violations involving re-entry as an aggravated felon. Information was not available on when Nava-Gutierrez had previously been deported, but agents said it was most likely after his release from Marion County Jail.

Officials said all people apprehended by border patrol agents undergo criminal history checks using biometrics like fingerprint analysis to identify those crossing the border illegally who have criminal histories.

In the fiscal year 2017, U.S. Border Patrol arrested almost 8,000 convicted criminals crossing the border illegally. Of those, 2,675 had outstanding warrants for their arrests. Read more about Border patrol agents arrest Marion County man convicted of rape, assault

An illegal immigrant began his murder trial for the 2014 killings of two Northern California sheriff's deputies on Tuesday with a profanity-laced rant, calling a partner of one of the slain officers a “coward.”

Prosecutor Rod Norgaard recounted the events that led to the death of Sheriff's Deputy Danny Oliver outside a Sacramento motel in October 2014, and described how Oliver's partner, Deputy Scott Brown, was able to retreat from the heavy gunfire.

Luis Enrique Monroy Bracamontes, 37, the alleged killer, interrupted the court when he grinned and called Brown a "coward." 

Bracamontes was scolded by the Sacramento Superior Court judge, The Sacramento Bee reported.  

"I wish I had killed more of the mother-------s," Bracamontes told the court. He continued: "I will break out soon and I will kill more, kill whoever gets in front of me...There's no need for a f---ing trial."

Bracamontes defense attorneys cited the outburst as more evidence that their client is unfit to stand trial.

His wife, 41-year-old Janelle Monroy, also is charged in the slayings. She argues that she was a victim of AN abusive husband who frequently used drugs.

Bracamontes, who could face the death penalty if convicted, has had similar episodes in court in the past.

Bracamontes is from Mexico, and repeatedly entered the United States illegally. His wife is an American citizen and faces life in prison if found guilty.  

Public defenders Jeffrey Barbour and Norm Dawson have unsuccessfully attempted to enter a plea of not guilty by reason of insanity, and argued that it is unlikely their client will receive a fair trial due to the anti-immigrant sentiment encouraged by President Trump’s hard line on immigration.

Information obtained from the Oregon Department of Corrections (DOC) indicated that on December 1, 2017 that 476 of the 973 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for three types of sex crimes (sex abuse, rape and sodomy), 48.92 percent of the criminal alien prison population.

Money problems at the Oregon agency that oversees Medicaid could be more than twice as large as already disclosed, a new report reveals.

Due to errors involving abortion, prison, undocumented immigrants and other factors, the state might have overpaid its contractors or owe other entities as much as $78 million...

....Allen listed $34 million that he said is owed to the agency or went untapped, due to budget and accounting problems....

The disclosures hint at the red meat the reports could serve up to the campaign to overturn $340 million in health taxes enacted to fund the state's Medicaid program....

In his letter to the governor on Friday, Allen laid out problems that ranged from the state paying Medicaid benefits for unauthorized immigrants to incorrectly using federal funds to pay for abortions.

Allen was careful to say that in most cases, staffers are still investigating the problems and the figures and other details will likely change as they learn more. He cited the following problems:

Medicaid for unauthorized immigrants: Oregon incorrectly paid health care organizations it contracted with to care for an undisclosed number of unauthorized immigrants, who were mistakenly listed in the state's computer system as being eligible for more than emergency room care. Allen did not identify the time frame in which the problem occurred, but it caused $25.7 million in "payment errors....

Health officials are still investigating another potential problem related to immigrants in the country illegally. Medicaid covers some emergency care for unauthorized immigrants plus prenatal and delivery care for pregnant women. As health staffers were preparing to implement a new abortion law earlier this year, they discovered the state might have been keeping these mothers on Medicaid after their babies were born, a time when the women were no longer eligible, Allen wrote....

Bariatric surgery payments: Oregon paid more than it should have for these weight loss surgeries from 2009 through 2015, and started trying to recoup the $1.5 million in overpayments a year ago. "As of October 2017, most of the overpayments have still not been repaid by providers, resulting in an accounts receivable balance of $1.1 million," Allen wrote....

Abortion coverage: The state estimates it used $1.8 million or so in federal funds for abortions, which it will have to repay. Federal law generally bans using federal funds to pay for abortions, although there are exceptions for cases of rape, incest and when the pregnant woman's life is in danger, according to the American Civil Liberties Union.

>>Money due to drug labelers: Oregon owes an estimated $22.3 million to drug labelers because the state has not passed along some of the money it was supposed to as part of the Medicaid drug rebate program.

Allen also cited problems at his agency and elsewhere with getting money to the right places. They included:

>> State accounting problem: The health authority has received an estimated $20 million from the Division of Child Support to pay for children's health care but has not properly accounted for that money. So state and federal programs were billed for the children's health care.

>>State budget problem: The health agency could gain $14.1 million for nursing facility and post-acute care that was incorrectly sent to the Department of Human Services over the past year.

The health authority might also be able to get federal money for services it has not sought reimbursement for in the past, or for which it claimed less federal funding than it could have, Allen wrote. Examples include services provided to tribal members at non-tribal facilities, and certain preventive services.

The Oregon Department of Corrections (DOC) October 2, 2017 Inmate Population Profile indicated there were 14,728 inmates incarcerated in the DOC’s 14 prisons.

Data obtained from the DOC indicated that on October 2nd there were 971 foreign nationals (criminal aliens) incarcerated in the state’s prison system; approximately one in every fifteen prisoners incarcerated by the state was a criminal alien, 6.59 percent of the total prison population.

Some background information, all 971 criminal aliens currently incarcerated in the DOC prison system were identified by U.S. Immigration and Customs Enforcement (ICE), a federal law enforcement agency that is part of the U.S. Department of Homeland Security. If an inmate is identified by ICE as being a criminal alien, at the federal law enforcement agency’s request, DOC officials will place an “ICE detainer” on the inmate. After the inmate completes his/her state sanction, prison officials will transfer custody of the inmate to ICE.

Beyond the DOC criminal alien incarceration numbers and incarceration percentages, per county and per crime type, or even country of origin, criminal aliens pose high economic cost on Oregonians.

An individual prisoner incarcerated in the DOC prison system costs the state approximately ($94.55) per day.

The DOC’s incarceration cost for its 971 criminal alien prison population is approximately ($91,808.05) per day, ($642,656.35) per week, and ($33,509,938.25) per year.

Even taking into account fiscal year 2016 U.S. Bureau of Justice Assistance (BJA), U.S. Department of Justice, State Criminal Alien Assistance Program (SCAAP) award of $1,788,075.00, if the State of Oregon receives the same amount of SCAAP funding for fiscal year 2017, the cost to incarcerate 971 criminal aliens to the DOC will be at least ($31,721,863.25). Note: At this point in time there is no indication the U.S. BJA will provide SCAAP awards in 2017.

None of preceding cost estimates for the DOC to incarcerate the 971 criminal aliens includes the dollar amount for legal services (indigent defense), language interpreters, court costs, or victim assistance.

In a press release filed Friday, Immigration and Customs Enforcement announced that they apprehended an individual illegally entering the United States across the southern border who had previously been convicted in the States for sexually assaulting a minor.

Border patrol agents at the Ajo station near Tuscon, Arizona apprehended the pervert sneaking into the country on Thursday. After running a background check, authorities discovered that 29 year-old Raul Cano-Garcia had been convicted in Fresno, California for having sex with a child under the age of 14. Cano-Garcia was sentenced to three years, but it is unclear if he ever actually served any jail time or was simply deported.

President Donald J. Trump received massive criticism for kicking off his 2016 presidential campaign with comments saying Mexico was sending "rapists" when illegal aliens entered the country. Cano-Garcia, however, is one of many illegal aliens from Mexico who have been convicted in American courts for some kind of sexual offense.

Statistics are not available right now for how many illegal aliens in jails across America are sex offenders, but a report out of Oregon last spring showed startling numbers within the state.

According to the Washington Examiner, nearly half of the illegal aliens in Oregon's jails are convicted sex offenders. 83% of those individuals convicted are from Mexico. The Examiner also reported last spring that under President Obama, ICE released nearly 600 sex offenders "for legal reasons." Many of these individuals were sent back to their native countries, but 151 one of them were denied admittance by those nations. Many of these individuals were released back into the streets of America.

Dale Wilcox, executive director of the Immigration Reform Law Institute, told the Examiner these numbers highlight the need for serious immigration reform.

"The anti-borders left routinely inject sanctimony into the immigration issue claiming that anyone with opposing arguments is morally inferior," said Dale Wilcox, executive director of the Immigration Reform Law Institute.

"But when statistics like this come out, statistics which show the horrific consequences of having an unregulated immigration system, they merely step over them like they don't exist," he added.
