Supreme Court Allows Remain in Mexico Policy to remain in place

The Supreme Court on Wednesday upheld the Trump administration’s “Remain in Mexico” policy requiring asylum seekers to wait in Mexico while their applications are processed in the U.S.

The court’s decision overturns a 9th Circuit Court of Appeals injunction against the policy covering the entire U.S.-Mexico border. Justice Sonia Sotomayor was the only judge who dissented. ICE‘s heroic achievements

The much-maligned ICE agents (U.S. Immigration and Customs Enforcement) are actually saving our country from extensive harm by criminals -- proof of this is in the ICE news release of December 6 summarizing results of their investigations for this fiscal year.

Citizens need an effective and supported Immigration and Customs Enforcement Team.  Presently incarcerated in the Oregon Department of Corrections are 126 illegal aliens serving time for murder, 168 serving time for rape and 183 for sexual abuse.  They, illegal aliens, commit serious crimes far out of proportion to what would be expected from their cohort.

ICE HSI ANNOUNCES RECORD-HIGH NUMBER OF CRIMINAL ARRESTS IN FY19

WASHINGTON – During fiscal year 2019 (FY19), U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI) effectively combated transnational criminal threats against the United States resulting in a record-breaking number of criminal arrests. HSI is the principal investigative component of the Department of Homeland Security…

HSI arrested 5,750 criminals associated with human smuggling investigations in FY19, a 41 percent increase from FY18, due in part to the use of Rapid DNA testing technology to detect fraudulent families at the Southwest border. During FY19, over 400 HSI personnel deployed to the southern border to protect children from being smuggled into the United States through fraudulent family units, often tied to larger transnational criminal syndicates.

In FY19, HSI arrested 2,197 criminals associated with human trafficking, a 38 percent increase from FY18, as well as identified and/or assisted 428 victims of human trafficking in FY19, a 39 percent increase from the previous year. HSI uses a victim-centered approach in its trafficking investigations, where equal value is placed on both the identification and stabilization of victims and prosecution of the traffickers. HSI also developed the Strategic Trafficking Outreach Program (S.T.O.P.) to educate and raise awareness as well as how to report instances of suspected trafficking.

HSI saw a record-breaking year in narcotics enforcement by leveraging partnerships and using a variety of task forces, including its Border Enforcement Security Taskforce (BEST). HSI seized more than 12,450 lbs. of opioids in FY19 – a record-breaking amount – exceeding FY18 seizures by more than 2,500 lbs. HSI also seized more than 3,600 lbs. of fentanyl and made more than 1,900 fentanyl-related arrests in FY19, which are both substantially higher than FY18 figures. HSI also seized more than 145,000 lbs. of methamphetamine in FY19.

Identity and benefit fraud pose a severe threat to national security. HSI leads 36 Document and Benefit Fraud Task Forces (DBFTF) across the country to combat this fraudulent activity. HSI made 2,198 arrests tied to identity and benefit fraud in FY19, a nearly 75 percent increase from FY18.

HSI also continued its fight against child predators and transnational gangs in FY19.  In FY19, HSI arrested 3,957 child predators as well as rescued or identified 1,069 victims.  HSI also made 3,886 criminal gang arrests, including 337 criminal arrests of MS-13 gang members during the same timeframe. …

Journalistic Horse Blinders Keep Key Facts from the Public; Isn't finding and reporting facts the reason for the media's existence?  By Dan Cadman on September 9, 2019

On September 6, American Airlines (AA) mechanic Abdul-Majeed Marouf Ahmed Alani was arrested and charged in federal district court in Miami with sabotage of a commercial aircraft. Video footage revealed he was the reason behind a "mechanical" difficulty that forced cancellation of a flight from Miami to the Bahamas back in mid-July. (See here and here.)

He has been charged with, and allegedly confessed to, spraying foam glue into a tube used for navigation instruments. This is no small matter — those instruments are particularly necessary in hazardous or turbulent weather conditions.

Very few of the media articles I've examined spoke to the man's background — a curious, but all too typical horse-blinders approach many journalists take these days whenever a case might depict immigrants in a bad light. (The same thing happened recently in a case involving several illegal alien MS-13 gang members arrested and accused of murder in Baltimore County, Md. There was at first a cone of silence that descended over the arrest of these "Maryland men".)

In this instance, an interesting smattering of facts have come out in the days following Alani's arrest: He originally came to the United States from Iraq as the spouse of a U.S. citizen who petitioned for him; he subsequently naturalized, in 1992; when he was arraigned, his English was so poor that the judge ordered an Arabic interpreter; and at least one news outlet says that he was at one point a mechanic at both American and Alaska Airlines, but Alaska fired him for "mistakes" and irregularities of some kind (not further explained), as well as for submitting fraudulent time sheets. Subsequent to being terminated, he filed a discrimination complaint — one might guess unsuccessfully, given that the firing was not reversed.

There are so many things to chew on in that smorgasbord of factoids.

I can't help but wonder about his marriage. Was it arranged, and/or was there a vast disparity in age? Are they still wed, or was it a marriage of convenience?

What about his naturalization? How is it that he passed the examinations (27 years ago!), which are supposed to require competent English language skills before one can assume the mantle of citizenship? It sure seems like those responsible for immigration and naturalization matters at U.S. Citizenship and Immigration Services have ample reason to go back and do a thorough post-audit of Alani's file. Want to beef up your vetting? Take the time to look at how your mistakes are made, and learn from them.

And if his command of English is so poor that the judge called for an interpreter, how could he possibly be working as a competent mechanic, all of whose manuals, instruction guides, tutorials, and courses would be in English? How could he have interacted with pilots, other mechanics, and the host of others involved in airplane maintenance? What does American Airlines have to say about this? So far, it would appear no one in the media has asked, even though post-arrest, American immediately issued a press release saying in pertinent part:

At American, we have an unwavering commitment to the safety and security of our customers and team members and we are taking this matter very seriously. At the time of the incident, the aircraft was taken out of service, maintenance was performed and after an inspection to ensure it was safe the aircraft was returned to service. American immediately notified federal law enforcement who took over the investigation with our full cooperation.

Then there's that Alaska Airlines firing in 2008: In light of this most recent criminal malfeasance, it sure seems like somebody needs to go back and carefully reexamine those past mechanical mistakes at Alaska, or that an enterprising investigative journalist might want to dig a little further even if officialdom and the corporate world don't.

Also puzzling: American Airlines had to know about Alani being terminated from Alaska Airlines; it became a Federal Aviation Administration (FAA) investigation at one point (though why isn't clear). What's more, part of the basis for his firing was that he claimed to be on the clock at both airlines at the same time so that he could double-dip. So why did American Airlines keep him on? The question begs to be asked, especially in light of American's public statement.

In fact, why did the FAA or Transportation Security Administration continue to credential him to work in an environment as sensitive as an airport in this post-9/11 world after his 2008 firing? Were one and all more afraid of a discrimination complaint than they were the safety of passengers?

Pres. Trump’s new drive for swift deportation of illegal aliens began on Sunday, July 14.  Now we see the predictable hysteria from open borders advocates. 

Here’s a great explanation of the fundamental necessity of deporting illegal aliens. The writer, Brandon Judd, is president of the National Border Patrol Council (NBPC), representing approximately 16,000 Border Patrol agents.

Our nation’s capital is paralyzed by political gridlock. Democrats and Republicans often refuse to fight through the gridlock, and the American people they are supposed to serve pay the price. There is no better example of this than our illegal immigration disaster.

The United States became the greatest nation on earth because of our Constitution, which is the foundation of the laws that govern our land.  From the beginning of our country’s history, we’ve believed in the rule of law which has provided opportunity and prosperity to all who reside within our borders.  We are the envy of the world – which is the reason we face illegal immigration rates not seen by other nations year after year.

Given our prosperity, freedom and opportunity, it is unfathomable that Democrats are so intent on destroying one of the pillars that has supported our great nation for so long, the rule of law.

Consider three of the countries from which so many people are fleeing today –Guatemala, Honduras, and El Salvador.  All three countries are rich in natural resources. All three countries have seaports, which allow for trade with other countries. They all have an able and willing workforce. So why aren’t they prosperous? Because all three countries have governments that fail to uphold the rule of law.

Consider Mexico and its gun laws. 

Of all the nations that hold free elections, Mexico has some of the strictest gun laws.  Notwithstanding those laws, Mexico has the highest murder rate of all free nations. And most of the murders are committed with illegal firearms.

They have extremely tough gun laws, but because bribery runs rampant and the laws aren’t evenly enforced, they mean nearly nothing. Many of Mexico’s citizens who can’t bribe their way out of obeying gun laws are ruled over by armed mobs of drug traffickers, common thugs who have zero respect for laws.

Mexico’s gun laws sound eerily similar to our immigration laws. The United States has some good immigration laws. The laws are intended to provide for an orderly immigration system. Immigration is supposed to work for the benefit of the United States, not for the benefit of lawbreakers who have no respect for our laws.  We are a country of immigrants, most of whom came to the United States legally.  The U.S. accepts more legal immigrants than any other nation in the world, yet we still have an illegal immigration problem that is out of control.

The major breakdown and the key magnet drawing people to cross our borders illegally is our failure to enforce the laws that currently exist.

The highly-publicized Immigration and Customs Enforcement (ICE) raids which kicked off Sunday are the only examples you need to see in order to understand the complete breakdown in the rule of law. This breakdown is why people from other countries feel so empowered to come to the U.S. illegally.

Some of the most powerful people in the United States, including Speaker of the House Nancy Pelosi and former first lady, Senator and Secretary of State Hillary Clinton, are helping people in the United States evade justice.

Nobody should wonder why we face a crisis at the border greater than anything we experienced during the Obama administration.

Powerful people are intent on upending the rule of law.  They would rather see the fabric that made our society the envy of the world torn to shreds, traded for personal power and political gain. 

Incessantly attacking, dehumanizing and endangering our law enforcement officers and agencies who are simply trying to enforce the laws that our legislators enacted in the first place is wrong.

Attacking the rule of law is wrong.

Some New York Clerks Refuse To Issue Driver’s Licenses To Illegal Aliens Under New Law

Some county clerks in upstate New York say they will refuse to comply with the state’s new law granting driver’s licenses to illegal aliens.

Clerks in Erie, Rensselaer, Niagara and Allegany counties say they won’t adhere when the law, signed Monday by Gov. Andrew Cuomo, takes effect in six months.

“In the memo of the bill, they talk about the reason why they’re passing this bill is to make sure that people who are here illegally can get to and from work,” Erie County Clerk Michael Kearns said, according to the New York Post. “It is illegal to hire people in the state of New York or anywhere that are here illegally. There’s an inconsistency there.”

 

 

In a letter to County Aattorney Michael Siragusa, Kearns asked for state representation in a lawsuit over the legislation in federal court, WIVB in Buffalo reported.

“After a review of the act, I am convinced that it is inconsistent with federal law,” Kearns wrote in the letter. “More importantly, however, complying with the act puts me and other county clerks in the untenable position of having to decide whether to uphold federal law or the newly enacted state law. I anticipate being sued in either event.”

Kerns said motor vehicle agencies in the area will instead send applicants who state employees believe are in the country illegally to the bureau in Syracuse.

"Speaking with WIVB, Kearns also reportedly suggested the bill may be a violation of the Immigration Reform and Control Act of 1986, which would make it illegal to knowingly hire illegal immigrants,” Fox News reported.

"When asked if he is prepared to lose his position if he doesn’t comply with the law Kearns told the television station, “He [Governor Cuomo] has the power. However through my research, working through my legal team, we have to be charged. There has to be some charges, and I get to answer those charges. It’s almost one of those things we’re preparing for. I hope it doesn’t happen.”

Cuomo’s office did not immediately respond to Fox News’ request for comment. His support for the bill appeared in doubt Monday after he voiced concerns that U.S. immigration officials could use state license information to target immigrants for deportation.

The governor asked for a legal review by the office of Attorney General Letitia James, who said she supports the bill but wouldn’t speculate on the federal response.

Supporters of the bill include the state Business Council and immigrant advocates who think licenses would help immigrants get jobs.

Republican lawmakers argue that illegal immigrants shouldn’t be rewarded for violating the rules.

Cuomo signed the Green Light Bill into law Monday night, making New York the 13th state to allow foreigners in the U.S. illegally to obtain driver’s licenses.

Kearns told 7 Eyewitness News “I’m not going to break the law. I can’t, in good conscious, do this.”

“It’s more than just driving. It’s a privilege. It’s a gateway document, it’s a breeder document, and I’m not going to be a part of that,” Kearns said.

The Next Influx: The Entire World's Poor and Dispossessed;

Tens of Thousands of "Exotics" and "Extra-Continentals" from around the Globe Moving Through Panama, by Todd Bensman, Center for Immigration Studies, July 1, 2019

Like the proverbial "bulge in the belly of the snake," unusually high numbers of non-Latino migrants, obviously not from Central America, are now reportedly passing from Colombia through Panama on their way to the U.S. southern border. Their numbers range to the tens of thousands, whose vanguards we have already seen at the U.S. Southwest Border in recent months: Cameroonians, Ghanaians, Congolese, Haitians, Cubans, and some from the Middle East.

Word of their successful entries into the United States this year clearly reached home countries because now a swell numbering as many as 35,000 is on an infamous migrant passage through which migrants have long funneled from South America to North America: the Darien Gap.

I am told this by two eye-witnesses who have just returned from the Colombia-Panama region on either side of the Gap. One of them is Panama-based author and freelance journalist Chuck Holton, who just visited the Colombian side in the frontier border town of Turbo, which is notorious as a migrant staging area for U.S.-bound migrants to be smuggled through the Darien Gap passage into Panama. The other source is Diane Edrington, a Mississippi-based nurse practitioner who has worked for years as a Panama Missions volunteer and who just returned from camps I visited in December on the Panama side of the Darien Gap.  ...

Holton told me he interviewed many migrants on the Colombian side who uniformly told him they decided to go to America, claim asylum, and take advantage of the disarray and laws about which they've all heard, from media reporting and those who already made it, that guarantee they will get to live and work for years in the United States, and probably permanently.

"'Trump wants to keep us out, but he can’t do it,'" Holton said he was repeatedly told in Turbo, Colombia as African migrants were preparing to board boats to the jungle trails for 10-day, smuggler-led wilderness treks into Panama. "They were very clear about that. 'If I can get in now, I'm going to get while the getting’s good.'"

Holton said everyone knew to go to American "sanctuary cities," where local authorities won’t cooperate with Immigration and Customs Enforcement.

"They have some level of understanding of what a sanctuary city is. 'If we can get to one of those they won’t mess with us; They won’t get us out.'"

The migrants he interviewed also were well aware of the time it takes for their asylum claims to be processed in a severely backlogged American system and that this was a major factor in deciding to leave home. (Migrating for improved lifestyle or economic reasons is not among the factors covered by U.S. asylum law).  ...

Control Flow Policy Out of Control

After my own trip to Panama and Costa Rica, I disclosed the existence of a formal bilateral policy by which both countries systematically transport migrants coming off the Darien Gap through their own territories and on to Nicaragua, where the smugglers can pick them up and keep them moving to the U.S. border.

Controlled Flow would likely spark controversy in the United States if anyone knew about it. The way it works is that Panama feeds, houses, shelters, and medically treats the migrants it collects out of the Darien jungle, then puts them on buses and hands them off to the Costa Ricans, who likewise move them to Nicaragua’s border. In this way, neither country gets stuck for long with large numbers of unwanted migrants, even though this just passes the hot potato problem to the U.S. southern border.

But now, according to Edrington and Holton, the policy is out of control due to the overwhelming pressure of the new influx. …

Of National Security and Marshall Plans

The policy implications of this new higher traffic coming at the border is at the very least two-fold.

During the Democrat presidential debates, candidates put forth as a primary solution to the Central American illegal immigration crisis at the southern border a "Marshall Plan," ala the economic rehabilitation of Europe after World War II, by which Americans would invest billions to build the economies of Honduras, El Salvador and Guatemala. The idea, according to candidates like San Antonio’s Julian Castro, is that a Marshall Plan would reduce the economic push factors driving hundreds of thousands of migrants to the southern border.

The new influx on its way to the American border puts this idea to a harsh logic fallacy test.

If a Marshall Plan is the ideal solution for mass migration influxes from wherever, what then about Cameroon, the Democratic Republic of Congo, Ghana, Haiti, Cuba and any other country whose population suddenly decide to transfer over the American border? How about a Marshall Plan for the entire world of impoverished nations? These questions should be raised when this particular influx hits the border in earnest.

Secondly, the new influx also must raise security questions when it starts to wash over the border. Migrants from the Middle East and Muslim-majority nations where terrorist organizations operate are in this extra-continental flow and often arrive with no verifiable identification. That’s a national security vulnerability that must be adequately acknowledged and dealt with, especially when one considers reporting about this reputed ISIS plot to send operatives over the U.S.-Mexico border and the recent apprehension in Nicaragua of two Iraqis and two Egyptians reputed to be affiliated with ISIS.  …

Lastly, American lawmakers will need to consider the broader question of how to turn off this flow at its Panamanian and Costa Rican spigot, wide open now due to the Controlled Flow policy. One way, as I've also suggested among this list of eight policy recommendations, is for the United States to help Panama pay for a nonstop airlift of repatriation flights to homelands all over the world. …

Trump administration prepares to release Central American migrants 'across the entire nation'

The Trump administration is preparing to send Central American migrants caught along the southern border to Border Patrol stations "across the entire nation," according to a senior Border Patrol official who confirmed the plans Friday.

With more than 4,500 people being caught each day crossing the U.S.-Mexico border, the agency has run out of room at its Border Patrol facilities in the four border states. The agency has started looking at its facilities around the country, which are mostly along the northern border with Canada and coastal states.

That means states from Oregon to North Dakota to Maine may begin receiving planeloads of migrant families in the weeks to come. On Tuesday, Customs and Border Protection sent its first plane full of migrants from Texas to San Diego.

The official confirmed reports on Thursday that the Florida counties of Broward and Palm Beach are under consideration given the size and capabilities of Border Patrol stations in the South Florida region. But he did not say if the decision is final or when the flights would start.

Asked whether any federal funds would be provided to help local communities deal with the relocation of migrants, the CBP official on Friday said he was not "aware" of any such plans.

The CBP official, who spoke on the condition of anonymity to brief reporters on the agency's internal discussions, said politics is not playing a role in its search for places to process and release migrant families despite President Donald Trump's commentsthat he wants to send migrants to so-called "sanctuary cities" that do not fully cooperate with federal immigration officials.

"Due to the fact that Democrats are unwilling to change our very dangerous immigration laws, we are indeed, as reported, giving strong considerations to placing Illegal Immigrants in Sanctuary Cities," Trump tweeted last month.

Instead, the CBP official said they are searching only for Border Patrol facilities with the space and computer systems necessary to process large number of migrants each day. The official said the agency is not sending migrants to parts of the U.S. closest to their requested destinations, but making transportation decisions solely on each Border Patrol station's ability to receive large numbers of migrants.

Palm Beach County Sheriff Ric Bradshaw said on Thursday that he was told by local Border Patrol officials to expect flights to start arriving in the area within two weeks, and that South Florida would receive about 1,000 migrants a month.

Officials in both counties complained that the transfers are coming with no apparent plan to house, feed, or care for the migrants after they're released from custody.

Migrants to Florida? Broward and Palm Beach officials worry about migrants dumped in their communities

Florida Gov. Ron DeSantis, a Republican and ardent supporter of Trump, said he didn't know much beyond news reports about plans to release migrants in his state. But he said that if true, it would be a big problem.

"We cannot accommodate in Florida the dumping of unlawful migrants into our state. I think it will tax our resources, our schools, the healthcare, law enforcement, state agencies," he said after a bill-signing ceremony Friday, according to the Miami Herald.

The CBP official could not estimate the average cost of each flight. But on Monday, Immigration and Customs Enforcement (ICE), which operates the flights, issued a public request for a contractor to handle up to 60,000 migrant transfers a year, with the vast majority of them (88%) being transfers by air.

Border Patrol has complained that its facilities have been overwhelmed by the record number of migrant families crossing the border, most of them requesting asylum to stay in the U.S.

Immigration and Customs Enforcement, which is responsible for interior immigration enforcement and has more detention space available, has also said it's running out of space.

That led Border Patrol agents in March to begin releasing migrants directly into local communities, at bus stations, community shelters, churches and other places along the border. That's been happening in Tucson since March.

CBP tried shuttling migrants between Border Patrol stations along the southern border, sending busloads of migrants from the flooded Rio Grande Valley sector in eastern Texas to other Border Patrol facilities in central and western Texas.

Now, the agency is looking all around the country to find more facilities that can help process the migrants. U.S. Federal Bureau of Prisons: Criminal Alien Report April 2019

The United States having a significant foreign national population residing within the nations boundaries, be they legally or illegally present in the country, unfortunately includes those who commit crimes.

The extent and impact of foreign national crime on the U.S. citizens and residents of this country is clearly revealed by a simple search on the U.S. Federal Bureau of Prisons (BOP) inmates statistics website under the heading of inmate citizenship.

Here are the countries of origin, moreover, the number and percentage of those countries citizens recently incarcerated in the U.S. BOP prison system (Note: The most recent BOP crime numbers available were from April 27, 2019.).

Inmate Citizenship:

- México 21,719 inmates, 12.1 percent;
- Colombia 1,643 inmates, 0.9 percent;
- Dominican Republic 1,444 inmates, 0.8 percent;
- Cuba 1,166 inmates, 0.6 percent;
- Other / unknown countries 8,957 inmates, 5.0 percent;
- United States 145,263 inmates, 80.6 percent;

Total Inmates: 180,192 inmates.

To explain the meaning of these preceding criminal alien inmate numbers and percentages, I will translate them into words:

Combining April 27th BOP criminal alien inmate numbers, there were 34,929 criminal aliens in the BOP prison system. Alien inmates were 19.4 percent of the federal prison population.

With 21,719 Mexican nationals being incarcerated in the BOP prison system, at 62.2 percent, they were the vast majority of criminal aliens in federal prisons.

The U.S. Federal Bureau of Prisons breaks down the federal prison population into 13 types of offenses. One of the top five offenses, the reason inmates are serving time in federal prisons is for immigration crimes. There were 10,946 inmates in the BOP prison system incarcerated for immigration crimes; they were 6.5 percent of the federal prison population.
