A report issued today by the nonpartisan Congressional Research Service (CRS) has found that criminal illegal aliens released by the Obama Administration's lax enforcement of immigration laws committed more crimes after their release, including murder, rape, kidnapping and child molestation.

The CRS completed the report using data obtained by the House Judiciary Committee last fall after the Committee learned that the Administration would release certain illegal aliens detected through the Secure Communities program. Secure Communities is a program that checks individuals booked into local jails with immigration data on file with DHS. The House Judiciary Committee subpoenaed DHS to release the data.

The key findings of the report include:

- The data provided to the House Judiciary Committee by DHS includes 276,412 records of charges against illegal and criminal immigrants identified by Secure Communities between October 27, 2008 and July 31, 2011. There are 159,286 unique individuals in the database and 205,101 unique arrest incidents.

- Of those released, CRS found that about 17% of illegal and criminal immigrants, or 26,412, were rearrested on criminal charges. These 26,412 recidivists accounted for a total of 42,827 arrests and 57,763 alleged violations.

- The categories of crimes charged include nearly 8,500 DUI (14.6%), over 6,000 Drug Violations (10.9%), more than 4,000 Major Criminal Offenses (7.1%), which includes murder, assault, battery, rape, and kidnapping, nearly 3,000 Theft (4.9%), and over 1,000 Other Violent Crimes (2.1%), which includes carjacking, child cruelty, child molestation, domestic abuse, lynching, stalking, and torture.

- These crimes committed by both illegal and legal immigrants include 59 murders, 21 attempted murders, and 542 sex crimes.

- Of those rearrested, nearly 30%, or 7,283, were illegal immigrants. Since 46,734 illegal immigrants were released, this means they have a recidivism rate of 16%. These illegal immigrants should have been deported but the Obama administration’s lax immigration policies released them back into our communities.

- The crimes charged against these illegal immigrants include nearly 2,000 DUI (11.9%), over 1,400 drug violations (8.8%), and more than 1,000 major criminal offenses and violent crimes (6.9%), including murder, assault, battery, rape, kidnapping, child molestation, domestic abuse, lynching, stalking, and torture.

- These crimes committed by illegal immigrants include 19 murders, 3 attempted murders, and 142 sex crimes.

"President Obama’s reckless amnesty agenda is dangerous and deadly for Americans," House Judiciary Chairman Lamar Smith said. "Rather than protect the American people he was elected to serve, President Obama has imposed a policy that allows thousands of illegal immigrants to be released into our communities. They have committed thousands of more crimes, including 19 murders, 3 attempted murders, and 142 sex crimes, which could have been avoided.

"For example, after an illegal immigrant was released, he and another illegal immigrant were arrested on suspicion of killing a man. And this is just one case. Illegal immigrants released from jail have committed other crimes, including nearly 2,000 DUI, over 1,400 drug violations, and more than 1,000 major criminal offenses and violent crimes, which consist of murder, assault, battery, rape, kidnapping, child molestation, domestic abuse, lynching, stalking, and torture.

"The Obama administration could have prevented these senseless crimes by enforcing our immigration laws. But President Obama continues to further his anti-enforcement agenda while innocent Americans suffer the consequences. His unwillingness to enforce immigration laws puts our communities at risk and costs American lives. We elect leaders to protect us – not put us in danger."

Roughly one in six illegal immigrants is re-arrested on criminal charges within three years of release, according to new government data being released Tuesday.

Those charges range from murder to drunken-driving and, according to House Republicans pushing out the report, are symptoms of what they describe as a "dangerous and deadly" immigration policy.

The findings, obtained by Fox News, are contained in reports by the Republican-controlled House Judiciary Committee and nonpartisan Congressional Research Service. They are the result of the committee’s subpoena request for Department of Homeland Security records from October 2008 to July 2011.

The information was analyzed by the CRS, which also broke down the information for criminal immigrants -- legal immigrants who committed crimes and were arrested again over the three-year period. Together, the two groups also had a roughly one-in-six recidivism rate.

The records show 276,412 reported charges against illegal and criminal immigrants over that three-year period as identified by Secure Communities, a federal program that essentially attempts to make best use of resources by identifying and prioritizing which illegal immigrants pose the biggest threat to public safety and should be arrested or deported.

Of the 160,000 people in the database, more than 26,000 were re-arrested -- accounting for nearly 58,000 crimes and violations.

They allegedly committed nearly 8,500 drunken-driving offenses and more than 6,000 drug-related violations. The records also show major criminal offenses, which included murder, battery, rape, kidnapping and nearly 3,000 thefts. Roughly 2 percent of the crimes included carjacking, child molestation, lynching and torture, according to the 13-page Congressional Research Service report.

“The Obama administration could have prevented these senseless crimes by enforcing our immigration laws,” the committee chairman, Rep. Lamar Smith, R-Texas, said. “But President Obama continues to further his anti-enforcement agenda while innocent Americans suffer the consequences.”

The report showed that more than 7,000 of those re-arrested were illegal immigrants. Among their charges were 19 murders, three attempted murders and 142 sex crimes.

The records were subpoenaed last year in large part over concerns that Obama administration changes to Secure Communities was allowing “potentially millions of illegal and criminal immigrants to avoid current immigration law,” according to the GOP-led House committee.

The Department of Homeland Security could not be reached for comment.

Committee members cited one case in which an illegal immigrant was flagged by Secure Communities for a June 2010 vehicle theft and then arrested five months later for attempted grand theft.

He was then arrested roughly six months later in connection with murder. He and two other men allegedly attempted to rob a 68-year-old man. When the victim’s grandson intervened, the illegal immigrant allegedly shot and killed the grandson, according to the committee.

“While this illegal immigrant should have been detained and deported, he was not considered a priority under the Obama administration’s reckless immigration policy and was released onto our streets,” the committee concluded.

President Obama's Record of Dismantling Immigration Enforcement provides a comprehensive analysis of the Obama administration's relentless effort to undermine the enforcement of most U.S. immigration laws. The study details dozens of incremental steps taken by the Obama administration to weaken and restrict immigration enforcement, acts of raw intimidation against state and local governments that have attempted to enforce our immigration laws, and a campaign of deception designed to convince the American public that immigration laws are being respected and executed.

"In just three and half years, under the guise of exercising executive discretion, President Obama has effectively rewritten U.S. immigration policy without approval from Congress, the body which the U.S. Constitution grants plenary authority over immigration law." charged Dan Stein, president of FAIR. Since taking office in 2009, the administration has:

• Ceased meaningful worksite enforcement against employers who hire illegal aliens as well as the removal of illegal workers from the country.
• Severely limited immigration enforcement in the interior of the country.
• Undermined, and in some cases completely terminated, effective partnership programs with state and local law enforcement designed to identify and detain deportable aliens.
• Turned the Department of Justice (DOJ) into the administration's attack dog, filing lawsuits against state and local governments that have adopted immigration enforcement laws, and used the Department's Civil Rights Division to harass local governments when the lawsuits fail. At the same time, DOJ has ignored actions by states and localities which defy the administration's attempts to remove criminal aliens.
• Appointed advocates for illegal aliens to key policymaking positions within the Executive Branch.
• Repeatedly misrepresented and manipulated data in order to convince the American people that immigration laws are being enforced.
• Effectively nullified numerous immigration laws through excessively broad exercise of prosecutorial discretion.

"President Obama came to office pledging to enact a comprehensive amnesty for illegal aliens during his first year in the White House. He quickly recognized that neither Congress nor the American people were prepared to go along with his agenda," noted Stein. "Rather than respect the will of the American people and the constitutional authority of Congress to determine U.S. immigration policy, he has, through a series of incremental steps, gutted immigration enforcement and assured illegal aliens who have not committed serious felonies that they will be allowed to remain in this country.
