The list is based primarily on the Comparison Chart on Immigration from the 2018 Abigail Adams Voter Education Survey questionnaire.  We have added some information from other sources.

Good news: numerous candidates are known to support Measure 105.  There are probably additional supportive candidates.  We’ll be glad to add them to the list if they identify themselves to Oregonians for Immigration Reform at ofir@oregonir.org.

ICE detains man charged with manslaughter of Salem couple, DUI

A man accused of killing a Salem couple while driving drunk was on his way back to Marion County Jail Monday following his arrest by deportation officers.

Eduardo De La Lima-Vargas, 39, of Hubbard, was taken into custody by U.S. Immigration and Customs Enforcement agents when he left the county jail after posting bail Thursday.

In a matter of hours, Marion County prosecutors filed a motion with the Marion County court to reconsider holding him without bail in order to prevent his removal from the United States so he can face prosecution for his alleged crimes here before being deported to Mexico.

According to ICE officials, De La Lima-Vargas is a citizen of Mexico residing illegally in the United States.

Marion County Judge David Leith ruled in the prosecutors' favor, and as of midday Monday, De La Lima-Vargas was en route to Salem from an ICE detention facility in The Dalles.

De La Lima-Vargas was first arrested after midnight on Aug. 19 on manslaughter, DUI and reckless driving charges.

According to police, he was driving his truck pulling an occupied horse trailer on Mission Street near Interstate 5 when he ran a red light and hit a motorcycle carrying Logan Wilson, 34, and Jessica Wilson, 32.

The Wilsons, a married couple with several young children, later died at Salem Hospital.

Responding officers described Vargas as smelling strongly of alcohol and swaying on his feet while standing. He failed a field sobriety test and his blood-alcohol content was at .10 percent two hours after the crash.

Several witnesses reported seeing him swerving and driving recklessly, according to court records. Two hours before the crash, he was involved in a property damage incident. After one witness called police and told him not to leave, De La Lima-Vargas allegedly threatened to shoot the witness and drove away.

Prosecutors noted that after the deadly crash, De La Lima-Vargas did not ask about the condition of the people he hit.

"He did, however, express concern for his horse, which had been in the horse trailer at the time of both of the crashes," prosecutors said.

De La Lima-Vargas also told investigators his wife was concerned about his driving the night of the crash. She offered to come and get him, but he declined because he did not know where he was.

Prosecutors said the public was at risk of physical injury if De La Lima-Vargas was released. They asked that he be held without bail.

Leith ordered that De La Lima-Vargas be held without bail until a hearing scheduled for Sept. 5.

During the hearing, Leith set bail at $500,000, finding that De La Lima-Vargas was charged with bailable offenses.

ICE officials confirmed that De La Lima-Vargas was taken into custody after posting $50,000 security the next day.

“ICE’s mission is to protect public safety by upholding the immigration laws of the country,"  ICE officials said in a statement Friday, adding that they considered De La Lima-Vargas to be threat to public safety.

ICE officials said they are not associated with the criminal proceedings in Marion County and would transfer De La Lima-Vargas back into local custody if Marion County prosecutors filed the appropriate motion.

Prosecutor Katie Suver filed a motion Friday asking the court to reconsider holding De La Lima-Vargas without bail to "protect the rights of the victims and the public and to avoid the possible removal of the defendant from the United States."

Suver said they were advised that De La Limas-Vargas could be removed from the country. Law enforcement would have no way ensuring his attendance at future court hearings if he was deported.

"At best, the defendant would remain in 'warrant' status and the case would never be tried," Suver said.

Shortly after prosecutors filed the motion, Leith ordered that De La Lima-Vargas be transported back to Marion County and held without bail until a new hearing scheduled for 8 a.m. Tuesday.

Prosecutors said the issue of bail will be addressed at the Tuesday hearing.

After De La Lima-Vargas's arrest, ICE issued an immigration detainer with Marion County Jail.

Detainers serve as a legally authorized request, upon which a law enforcement agency may rely, to continue to maintain custody for up to 48 hours so that ICE may assume custody for deportation.

"The Marion County Jail does not honor any aspect of an ICE detainer, absent a criminal arrest warrant issued by a magistrate judge," ICE officials said.

The issue of not honoring ICE detainers has become part of a contentious national debate over "sanctuary cities."

In November, voters will decide on whether Oregon should repeal its sanctuary state law, which prevents law enforcement from detaining people who are in the country illegally but have not broken other laws.

Oregon’s Marion County First in Foreign National Crime in July 2018

On July 1, 2018 Oregon’s Marion County had 229 of the 943 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was first in foreign national crime in the state with 24.28 percent of the criminal aliens in DOC prisons.

The following table reveals how Marion County residents were harmed or victimized by the 229 criminal aliens incarcerated on July 1st in the DOC prison system with U.S. Immigration and Customs Enforcement (ICE) ICE detainers.

Oregon’s Multnomah County Third in Foreign National Crime in July 2018

On July 1, 2018 Oregon’s Multnomah County had 186 of the 943 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was third in foreign national crime in the state with 19.72 percent of the criminal aliens in DOC prisons.

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2018 that 172 of 943 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for the crime of rape — 18.24 percent of the criminal alien prison population (Note: The number of criminal aliens incarcerated for rape in DOC prisons does not necessarily equal the number of Oregon residents victimized by the violent crime of rape).

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table reveals the total number of criminal alien inmates along with the number and percentage of those alien inmates incarcerated on July 1st in the state’s prisons for the crime of rape.

Significant numbers, the 172 criminal aliens in the DOC prison system incarcerated for rape were 17.64 percent of all inmates, domestic and foreign, in the state’s prisons for the crime of rape.

Criminal aliens from 21 identified countries incarcerated in DOC prisons have raped Oregon residents.

Foreign nationals who declared their country or origin as being Mexico were 140 of 172 criminal aliens convicted of rape incarcerated in the DOC prison system — 81.40 percent of the alien rapists in the state’s prisons.

Oregon Department of Corrections: Foreign National Homicide Report July 2018

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2018 that 136 of the 943 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for homicidal crimes (various degrees of murder and manslaughter) —14.42 percent of the criminal alien prison population (Note: The number of criminal aliens incarcerated for homicidal crimes in DOC prisons does not necessarily equal the number of Oregon residents killed by alien homicidal violence).

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table reveals the total number criminal alien inmates along with the number and percentage of those alien inmates incarcerated on July 1st in the state’s prisons for homicidal crimes.

Criminal aliens incarcerated in DOC prisons committed at least one crime of homicidal violence in 22 of 36 Oregon counties —66.11 percent of the counties in the state.

Seven Oregon counties, Multnomah (38 alien inmates convicted of homicides), Marion (24 alien inmates convicted of homicides), Washington (21 alien inmates convicted of homicides), Umatilla (9 alien inmates convicted of homicides), Clackamas (7 alien inmates convicted of homicides), Lane (6 alien inmates convicted of homicides) and Jackson (5 alien inmates convicted of homicides) had 110 of 136 criminal alien inmates incarcerated in DOC prisons for homicidal violence — 80.88 percent of the alien inmates in the state’s prisons for homicidal crimes.

Foreign nationals who declared their country or origin as being Mexico were 106 of 136 criminal aliens convicted of homicidal crimes incarcerated in the DOC prison system — 77.94 percent of the alien inmates in the state’s prisons for homicidal crimes.

Responding to The Oregonian on Measure 105

On Sunday, August 5, The Oregonian published an editorial supposedly giving “facts” about Oregon’s sanctuary law and attacking Governor-candidate Buehler for supporting its repeal. 

The editorial presented an unfair, inaccurate picture of Measure 105, a measure supported by OFIR which would repeal Oregon’s illegal alien sanctuary law – ORS 181A.820.

According to the editorial, “one incident (Sergio Martinez’s rape of one woman and the sexual assault of another”), is no reason to toss a state law that has served us well over the past three decades.”

Apparently The Oregonian is unaware that there are close to 1000 criminal aliens with ICE holds on them, now serving time in the Oregon State Prison.  No one gets sent to the state prison for a minor infraction.   136 are in for homicide and 474 for sex offenses (sex abuse, rape, sodomy). 

A respected expert in law enforcement would certainly not agree with The Oregonian’s assertion that the state’s sanctuary law is “common sense.”  U.S. Attorney for Oregon Billy Williams condemns the sanctuary law as a major hindrance in enforcing federal immigration laws  He said in an article in The Oregonian last year: “Simply put, Oregon's sanctuary status declaration directly contravenes federal immigration law and threatens public safety. This has put many sheriffs in the position of choosing whether to violate state or federal law. It's an untenable position. …”

Furthermore, The Oregonian’s editorial statement that illegal entry is not a crime is very misleading.  A single illegal entry is a misdemeanor but if repeated after being deported, becomes punishable as a felony.  Also, Immigration and Nationality Act Section 237 (a)(1)(B) says: "Any alien who is present in the United States in violation of this Act or any other law of the United States is deportable."  This means that any illegal alien and any immigrant who overstays a visa is lawfully subject to deportation at any time.

The Oregonian objects to use of a single offender to illustrate problems with Oregon’s sanctuary law, but the newspaper itself repeatedly uses examples of specific illegal aliens to milk the sympathies of gullible readers and influence them to accept illegal immigration generally.

There have been hundreds of sob stories about the woes suffered by individual illegal aliens and how cruel people are to object to their presence.  Where are equivalent reports of the sufferings of the hundreds of Oregonians who’ve been killed, raped, robbed or maimed by alien criminals now sitting in our jails with ICE holds on them for likely being in this country illegally?

What would happen to the “drug crisis” if there were not an ample supply of illegal aliens to expedite international drug trafficking?  What would happen to the homeless population if they did not have to compete with illegal aliens for living space and jobs at living wages?

Hopefully, voters in Oregon will see that, contrary to the views of The Oregonian, true “common sense” requires repeal of Oregon’s outdated sanctuary law, and they will stop Oregon sanctuaries by voting YES on Measure 105 in November. Read more about Responding to The Oregonian on Measure 105

Oregon Department of Corrections: Criminal Alien Report July 2018

The Oregon Department of Corrections (DOC) July 1, 2018 Inmate Population Profile indicated there were 14,916 inmates incarcerated in the DOC’s 14 prisons.

Data obtained from the DOC indicated that on July 1st there were 943 foreign nationals (criminal aliens) incarcerated in the state’s prison system; criminal aliens were 6.32 percent of the total prison population.

Some background information, all the criminal aliens incarcerated in the DOC prison system were identified by U.S. Immigration and Customs Enforcement (ICE) and have ICE detainers placed on them.

Using DOC Inmate Population Profiles and ICE detainer numbers, the following table reveals the total number inmates, the number of domestic and criminal alien inmates along with the percentage of inmates with ICE detainers incarcerated on July 1st in the state’s prisons.

Beyond the DOC criminal alien incarceration numbers and incarceration percentages, per county and per crime type, or even country of origin, criminal aliens pose high economic cost on Oregonians.

An individual prisoner incarcerated in the DOC prison system costs the state approximately ($108.26) per day.

The DOC’s incarceration cost for its 943 criminal alien prison population is approximately ($102,089.18) per day, ($714,624.26) per week, and ($37,262,550.70) per year.

None of preceding cost estimates for the DOC to incarcerate the 943 criminal aliens includes the dollar amount for legal services (indigent defense), language interpreters, court costs, or victim assistance.

On June 1, 2018 Oregon’s Marion County had 235 of the 957 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was first in foreign national crime in the state with 24.56 percent of the criminal aliens in DOC prisons.
