Oregon Department of Corrections: Criminal Alien Report for the Americas September 2017

Information obtained from the Oregon Department of Corrections (DOC) indicated that on September 1, 2017 there were 971 foreign nationals (criminal aliens) incarcerated in the state’s prison system.

Breaking the DOC criminal alien prison population down by a specific geographic region of the world, 856 of the prisoners self-declared countries of origin were located in the Americas: North, Central and South America and the West Indies (Excluding the United States of America and its territories):

- North America had 781 criminal aliens, 91.24 percent of the DOC prisoners from the Americas;

- Central America had 51 criminal aliens, 5.96 percent of the DOC prisoners from the Americas;

- South America had 17 criminal aliens, 1.99 percent of the DOC prisoners from the Americas;

- The West Indies had seven criminal aliens, 0.82 percent of the DOC prisoners from the Americas.

The 856 prisoners in the DOC prison system from the Americas were 88.16 percent of the total criminal alien prison population.

Some background information, all criminal aliens incarcerated in the DOC prison system were identified by U.S. Immigration and Customs Enforcement (ICE), a federal law enforcement agency that is part of the U.S. Department of Homeland Security. Once identified by ICE these criminal aliens had immigration detainers placed on them by immigration officials monitoring the state’s prisons. After these criminal alien inmates have completed their state sanctions, prison officials will transfer custody of these inmates to ICE.

Using DOC ICE detainer numbers, the following table reveals the self-declared countries of origin of the 856 criminal alien prisoners from the Americas by number and percentage incarcerated on September 1st in the state’s prisons.

The preceding table reveals that criminal aliens from 15 countries located in the Americas were incarcerated in the DOC prison system. Mexico with 778 prisoners equated to 90.89 percent of the criminal aliens from the Americas incarcerated in the state’s prisons.

The preceding table reveals that 426 criminal aliens (49.77 percent) of those DOC prisoners from the Americas were incarcerated for three types of sex crimes: sex abuse, rape and sodomy.

Twenty-eight Oregon counties had at least one criminal alien from the Americas incarcerated in DOC prisons. Four of the state’s counties, Marion, Multnomah, Washington and Clackamas had 621 prisoners (72.55 percent) of the criminal aliens from the Americas incarcerated in the state’s prisons.

Beyond the DOC criminal alien incarceration numbers and percentages by countries of origin, by crime types or by the state’s counties, criminal aliens from the Americas pose high economic cost on Oregon tax payers.

An individual prisoner incarcerated in the DOC prison system costs the state approximately ($94.55) per day.

The DOC’s incarceration cost for its 856 criminal alien prison population from the Americas is approximately ($80,934.80) per day, ($566,543.60) per week, and ($29,541,202.00) per year.

Even taking into account fiscal year 2016 U.S. Bureau of Justice Assistance (BJA), U.S. Department of Justice, State Criminal Alien Assistance Program (SCAAP) award of $1,788,075.00, if the State of Oregon receives the same amount of SCAAP funding for fiscal year 2017, the cost to incarcerate 856 criminal aliens to the DOC will be at least ($27,753,127.00). Note: At this point in time there is no indication the U.S. BJA will provide SCAAP awards in 2017.

None of preceding cost estimates for the DOC to incarcerate the 856 criminal aliens includes the dollar amount for legal services (indigent defense), language interpreters, court costs, or victim assistance.

Oregon’s Marion County First in Foreign National Crime in September 2017

On September 1, 2017 Oregon’s Marion County had 231 of the 971 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was first in foreign national crime in the state with 23.79 percent of the criminal aliens in DOC prisons.

Shooter in 2016 Aloha killing sentenced to life in prison

A 22-year-old man was sentenced Thursday to life in prison with the possibility of parole after 25 years for fatally shooting another man in Aloha in June 2016.

Roger Gastelum-Medina, standing in an orange jail uniform...apologized for killing 21-year-old Yusuf Sharif of Beaverton after an argument.

"I just want to say I'm sorry," he said. "I'm really sorry for everything."

Gastelum-Medina and Sharif knew each other before the shooting and both regularly used and sold methamphetamine, the prosecution and defense said during trial. The shooting was the culmination of "bad history" between Gastelum-Medina and Sharif, according to the prosecution. Gastelum-Medina believed Sharif owed him money from an earlier drug deal rip-off and he suspected Sharif was trying to woo Gastelum-Medina's girlfriend away from him.

Gastelum-Medina's mother was among a handful of his supporters in the courtroom. Sharif's family members weren't in the courtroom, but prosecutor Bracken McKey said they wanted the judge to know that they were grateful for the jury's guilty verdict.

Jurors found Gastelum-Medina guilty of murder and unlawful use of a weapon on Sept. 26. Washington County Circuit Judge Oscar Garcia found him guilty of being a felon in possession of a firearm in a separate bench trial related to the shooting. Garcia ordered Roger Gastelum-Medina to receive credit for the 16 months he's already spent in jail custody in the killing of 21-year-old Yusuf Sharif of Beaverton and ordered Gastelum, a native of Mexico, to not return to the U.S. if he is deported....

Additional charges of second-degree sexual abuse and third-degree rape involving the same girl were dropped as part of a plea agreement.

McKey said the plea deal was reached because of the murder conviction presented an almost certainty that Gastelum-Medina would serve at least two decades in prison...

Gastelum-Medina has been in the U.S. illegally, McKey said Thursday, and has a criminal history that includes a 2015 conviction for methamphetamine possession.

He was arrested by U.S. Immigration and Customs Enforcement in November 2015 and taken to the Tacoma Northwest Detention Center, McKey said. He was released in February 2016 on electronic monitoring.

According to a search warrant affidavit, Gastelum-Medina was required to pay for the GPS monitoring, but stopped in June 2016 and the service was shut off.

McKey said Gastelum-Medina continued to wear the ankle bracelet even though it wasn't tracking him, remained in Washington County and sold meth.

The GPS monitoring ended nearly two weeks before the shooting, according to the affidavit. McKey said ICE hadn't issued a warrant for Gastelum-Medina's arrest before then.

Lindsey said Gastelum-Medina was told by an immigration attorney that deportation is "imminent and virtually certain." Gastelum-Medina has matured now that "he is no longer saturated in methamphetamine culture," Lindsey said.

Oregon’s Washington County Third in Foreign National Crime in September 2017

On September 1, 2017 Oregon’s Washington County had 202 of the 971 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was third in foreign national crime in the state with 20.80 percent of the criminal aliens in DOC prisons.

Oregon Department of Corrections: Foreign National Drug Crime Report August 2017

Information obtained from the Oregon Department of Corrections (DOC) indicated that on August 1, 2017 that 112 of the 984 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for drug crimes, 11.38 percent of the criminal alien prison population.

U.S. Federal Bureau of Prisons: Criminal Alien Report August 2017

The United States having a significant foreign national population residing within the nations boundaries, be they legally or illegally present in the country, unfortunately includes those who commit crimes.

The extent and impact of foreign national crime on the U.S. citizens and residents of this country is explicitly revealed by a simple search on the U.S. Federal Bureau of Prisons (BOP) inmates statistics website under the heading of inmate citizenship.

Here are the countries of origin, moreover, the number and percentage of those countries citizens recently incarcerated in the U.S. BOP prison system (The most recent BOP crime numbers available were from August 26, 2017.).

Inmate Citizenship:

- México 25,255 inmates, 13.5 percent;
- Colombia 1,695 inmates, 0.9 percent;
- Dominican Republic 1,522 inmates, 0.8 percent;
- Cuba 1,234 inmates, 0.7 percent;
- Other / unknown countries 9,458 inmates, 5.1 percent;
- United States 147,271 inmates, 79.0 percent;

Total Inmates: 186,435 inmates.

To clarify the meaning of these preceding criminal alien inmate numbers and percentages, I will translate them into words:

Combining August 26th BOP criminal alien inmate numbers, there were 39,164 criminal aliens in the BOP prison system. Alien inmates were 21.0 percent of the federal prison population; more than two in every ten inmates were criminal aliens.

With 25,255 Mexican nationals being incarcerated in the BOP prison system, at 64.5 percent, they were the vast majority of criminal aliens in federal prisons.

The U.S. Federal Bureau of Prisons breaks down the federal prison population into 13 types of offenses. One of the top five offenses, the reason inmates are serving time in federal prisons is for immigration crimes. There were 13,598 inmates in the BOP prison system incarcerated for immigration crimes; they were 7.8 percent of the federal prison population.

An urgent wakeup call to all American citizens, eventually the majority of these criminal aliens from México, Colombia, Dominican Republic, Cuba and other countries will be released from the U.S. Federal Bureau of Prisons after completing their prison terms.

The country of Mexico, America’s neighbor to the south, is both historically and literally a land bridge of many frequently unsecured trails, roads, highways and railways used by persons trying and far too often successfully illegally entering our country.

United States citizens should, if they haven’t already, contact their members of the U.S. Congress (two Senators and one Representative) and tell them to support President Donald J. Trump’s commitment to build a wall (fences and technology) along the U.S. border with Mexico to stop the threat of tens of thousands of criminal aliens, once they are released from the federal prison system and deported by U.S. Immigration and Customs Enforcement to their countries of origin, ability to illegally return to this nation and harm its citizens and residents.

Oregon Department of Corrections: Foreign National Homicide Report August 2017

Information obtained from the Oregon Department of Corrections (DOC) indicated on August 1, 2017 that 138 of the 984 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for homicidal crimes (various degrees of murder and manslaughter), 14.02 percent of the criminal alien prison population.

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table reveals the total number criminal alien inmates along with the number and percentage of those alien inmates incarcerated on August 1st in the state’s prisons for homicidal crimes.

The free pass for criminal aliens bill

There was such a whirl of activity in the final days of the late, unlamented session of Oregon’s Legislature that further wounds to citizenship and the rule of law slipped through with very little notice.

Looking into the history of HB 2355, “Relating to public safety; and declaring an emergency,” we find that the innocent-sounding summary says:  “Directs Oregon Criminal Justice Commission to develop method for recording data concerning officer-initiated pedestrian and traffic stops.” 
 
The bill was said to be aimed at “racial profiling” – the claimed unfair treatment by police of racial minorities.  It was introduced on January 9, 2017. But because of amendments that conveniently came much later, HB 2355 might as well now be called the free pass for criminal aliens bill.
 
At a July 4 session of the House Ways and Means Committee which was considering HB 2355, a majority of Committee members voted to reduce the penalty for a Class A misdemeanor from the standard 365 days to 364 days.  What a difference a day makes!  Now aliens who may or may not be here legally can escape the federal rule that makes deportable those aliens convicted of Class A misdemeanors.
  
HR 2355 was pre-session filed at the request of Attorney General Ellen Rosenblum.  There was little publicity, and most voters were probably unaware of the contents of the bill, especially the addition of the part benefitting criminal aliens.  The bill sailed through House hearings with almost no public opposition.
 
The House vote was 36 Ayes and 23 Nays. All Democrats voted Aye except Rep. Boone who was excused.  All Republicans voted Nay except Reps. John Huffman and A. Richard Vial.
 
News of the bill’s passage on July 5 by the House appeared in some Oregon newspapers, referring to it as an anti racial profiling bill.
 
The bill went to the Senate the very next day, July 6, where it passed quickly without any hearing, and the Legislature adjourned on July 7.
 
The Senate vote was 20 Ayes and 9 Nays. Sen. Knopp (R) was excused. All Democrats voted Aye except Sen. Betsy Johnson, who voted Nay.  Republicans were split, 8 Nays to 4 Ayes. Republicans voting Nay were:  Sens. Baertshiger, Boquist, Ferrioli, Girod, Kruse, Linthicum, Olsen, Thatcher.  The Aye-voting Republicans were: Sens. DeBoer, Hansell, Thomsen, Winters.
 
An account of final passage was published on July 11 by the Portland Tribune, written by Paris Achen of the Capitol Bureau.  Like her account of House passage, it ended with this paragraph: 
 
“Another provision reduces maximum penalty for a Class A misdemeanor from 365 days of imprisonment to 364 days. That change was meant to prevent federal deportation of legal immigrants who are convicted of a Class A misdemeanor and may be a refugee, enrolled in school in the United States, or are the spouses or family members of a U.S. citizen, said Speaker Tina Kotek, D-Portland. A sentence of 365 days triggers mandatory federal deportation.” 
 
However, HB 2355 as amended and passed will benefit all criminal aliens legally and illegally here, not just a favored few.  This bit of legislative history illustrates how Oregon’s legislative leadership and allies deceptively manipulate human sympathy to expand benefits, incentivize illegal immigration, degrade the value of citizenship, and endanger public safety.
 

Oregon Department of Corrections: Foreign National Sex Crime Report August 2017

Data obtained from the Oregon Department of Corrections (DOC) indicated that on August 1, 2017 that 471 of the 984 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for three types of sex crimes (sex abuse, rape and sodomy), 47.87 percent of the criminal alien prison population.

The following table identifies the types, numbers and percentages of sex crimes committed by the 471 criminal aliens with U.S. Immigration and Customs Enforcement (ICE) immigration detainers incarcerated on August 1st in DOC prisons.
